The Malta Financial Services Authority (MFSA) has determined that Mr Kai Dai is no longer fit and proper to hold approved positions within the financial services sector, effectively barring him from the industry for ten years.
- Decision Date: 20 October 2026
- Divestment Requirement: All direct and indirect involvements approved by the Authority
- Ban Duration: 10 years from the decision date
- Legal Basis: Article 15(1) of the Investment Services Act (Chapter 370 of the Laws of Malta)
In its regulatory action issued on 20 October 2026, the MFSA directed Mr Dai to divest himself of all positions and involvements that received the Authority’s approval, whether held directly or indirectly. The regulator simultaneously prohibited him from accepting new positions that require MFSA approval, including qualifying shareholding positions in entities licensed or supervised by the Authority.
The ten-year prohibition marks a significant enforcement action by Malta’s financial regulator. Mr Dai retains the right to appeal the decision before the Financial Services Tribunal within the timeframe prescribed by applicable Maltese law.
The MFSA published the notice under Article 16(8) of the Malta Financial Services Authority Act and in accordance with the regulator’s Publication Policy, ensuring transparency in regulatory enforcement across the financial services industry.
