Indonesia Financial Services Authority (OJK) issued two regulations on September 17, 2026, establishing the framework for a new Mineral and Strategic Commodities Exchange (BMKS) and transferring regulatory oversight from the Commodity Futures Trading Regulatory Agency (Bappebti). The move implements a mandate from the amended Financial Services Sector Development Law and establishes infrastructure for transparent, efficient trading in strategic commodities.

  • Regulation 1: POJK Number 15 of 2026 – gradual transition of duties from Bappebti to OJK
  • Regulation 2: POJK Number 16 of 2026 – implementation framework for BMKS operations
  • Transition effective date: January 1, 2027 (initial BMKS operation day)
  • POJK 15 effective date: September 17, 2026
  • POJK 16 effective date: January 1, 2027

POJK Number 15 regulates the procedural transition of regulatory and supervisory authority from Bappebti to OJK, designed to maintain market stability and prevent legal gaps while minimizing operational disruption for market participants. The transfer takes effect on January 1, 2027, when the exchange begins operations.

POJK Number 16 establishes the operational and governance framework for BMKS, covering participant eligibility, trading procedures, clearing, settlement, risk management, and user protection. The exchange integrates trading, clearing, guarantee, settlement, and electronic ownership management functions. OJK emphasized that the regulations aim to foster a liquid, trustworthy market that maintains transaction certainty, market integrity, and fair pricing while protecting investor interests in Indonesia’s financial services sector.
